POLICY
:
Inasmuch as the Water and Power Resources Board imposed measuring and
recording requirements upon orders of confirmation issued subsequent to
February 13, 1947, the Department may modify existing orders of
confirmation, issued prior to or subsequent to that date, to require measuring
and recording of withdrawals to determine compliance with the order of
confirmation.
PURPOSE
:
The purpose of this policy is to provide a mechanism whereby the Department
can monitor compliance with orders of confirmation issued under the Water
Rights Act.
APPLICABILITY
:
This policy applies to all orders of confirmation issued to a public water supply
agency for direct withdrawal of surface waters.

affect regulatory requirements.

There is no intent on the part of the Department to give these rules that weight
or deference. This document establishes the framework, within which DEP
will exercise its administrative discretion in the future. DEP reserves the
discretion to deviate from this policy statement if circumstances warrant.
